SECTION 1. Payment Policy: We accept Visa, MasterCard, and Discover Card, as well as direct bank deposits. The credit/debit card used to make the reservation must be in the name of the primary renter on the reservation. At check-in, you are required to provide the SAME credit/debit card used to make the reservation. Please note that only one credit/debit card can be used per reservation.

At the time of making your reservation, YOU AUTHORIZE us to make an initial payment of $200 USD on your credit/debit card for the security of your reservation. This initial payment is non-refundable. You also AUTHORIZE us to charge the total amount of the reservation to your credit/debit card 30 days before your arrival. Failure to show or cancellation within 30 days will result in the loss of all pre-paid money.

SECTION 2. Damage Deposit: YOU AUTHORIZE us to make a damage deposit hold of $200 USD at the time of your Check-In. This damage deposit will remain as security until after your departure and until the unit has been inspected for losses or damages. If everything is in order, the release of this deposit will be processed. If not, you will be charged according to our Loss or Damage policy in SECTION 21. The damage deposit will be retained for a period of 7 business days.

SECTION 3. Credit/Debit Card Agreement: I am providing my credit/debit card number as a guarantee of payment to the rental company. I AGREE and AUTHORIZE payment for all rent and charges associated with property rental. I ACCEPT all terms outlined in the rental agreement, as well as your TERMS and CONDITIONS. I also ACCEPT full liability for the property, including any damage beyond normal wear and tear during the term of my lease with the Rental Company. I understand that these costs will be charged to my credit/debit card, and I AUTHORIZE the rental company to charge my credit/debit card for the payment of these items. The Rental Company may use any funds received from me upon their receipt of such funds.

SECTION 4. Online Reservations: During the reservation process on our website through our automated system, there is a direct link to these Terms and Conditions. To proceed with the reservation, there is a specific area where you must check a box, indicating your agreement to these TERMS and CONDITIONS. By checking this box, you confirm that you have thoroughly read and understood all the Terms and Conditions, and you agree to them.

SECTION 5. Confirmation of Reservations: After you have made your reservation you will receive an automated Booking Confirmation and a separate email with a copy of these TERMS and CONDITIONS attached. Please read the Booking Confirmation for accuracy of dates, mailing address, number of adults and/or children and accommodations. Any errors must be directed to reservations department immediately. You will be required to accept and sign our Booking Confirmation and return it to our reservation staff to the email given in order to confirm your reservation.

SECTION 6. Electronic Email Communications: Documents such as the Booking Confirmation and TERMS and CONDITIONS are sent to you through our Secure Email Verification System. This system assigned a security number to the communication confirming when it is sent. You agree to accept to all communications through this system as proof of delivery and confirmation that you have read and approved.

SECTION 7. Changes to Reservations: Any change to your reservation are subject to a $25 USD fee and only one modification can be made.

  • The modification to the reservation must be made at least 30 days prior to the arrival date.

SECTION 8. Cancellations: There are no refunds for No shows and Cancellations.

  • Confirmed reservations which are canceled more than thirty (30) calendar days before arrival will be charged a $200 USD cancelation fee.
  • Confirmed reservations which are canceled less than thirty (30) calendar days before arrival will be charged 100% of all prepaid amounts.

SECTION 9. Refund Policy: Our Agents cannot guarantee against mechanical failure of heating, air conditioning, TVs, VCRs, or other appliances. Please report any inoperative equipment to our office immediately. Agent will make every reasonable effort to have repairs done quickly and efficiently. No refunds or rent reductions will be made due to failure of appliances or equipment. No refunds for early departures (less days than reserved) – No refunds will be given for delayed arrival – No refunds for no show or cancellations. Neither Owner nor Rental Company shall be liable for events beyond their control which may interfere with Guest(s) occupancy, including but not limited to Acts of God, acts of governmental agencies, fire, strikes, war, or inclement weather, lack of electricity, water, internet in the city. NO REFUND will be offered or given in these circumstances.

SECTION 10. Occupancy: The primary renter must be 21 years of age or older. Each condo has a maximum occupancy, as well as a maximum number of adults/children allowed in the room. The rental is specifically designed to accommodate a certain number of people, known as the maximum occupancy. Guests aged 12 or older are considered adults. If more people are found in your rental than the number listed on your reservation, you may be subject to eviction without a refund of any prepaid rental payments or deposits, in accordance with the rules and policies of the resort. Visitors are not allowed in the resorts. Below are the maximum occupancy details for each condo:

  • 1 Bedroom Max Occupancy: 4 people; 2 adults / 2 children 12 years old and under.
  • 2 Bedroom Max Occupancy: 6 people; 4 adults / 2 children 12 years old and under.
  • 3 Bedroom Max Occupancy: 8 people; 6 adults / 2 children 12 years old and under.

SECTION 11. Check-In / Check-Out Times: CHECK-IN TIME IS after 4:00 PM – CHECK-OUT TIME IS before 11:00 AM. NO EXCEPTIONS! You will be charged $50 per hour you overstay the Checkout Time.

SECTION 12. Check-In Procedures: Check-in is conducted at either Castaways or Sonoran Spa Resort Reception, as designated during your reservation. If you anticipate arriving after regular hours, please inform us in advance so that arrangements can be made for Guest property keys to be picked up at Sonoran Spa Resort. All After Hours Reservations are processed at the Sonoran Spa Resort, and keys will only be available when the property is ready for occupancy. No exceptions will be made to this policy. While the Rental Company will make reasonable efforts to have the rental property ready for Guest(s) occupancy at the designated check-in time, it cannot guarantee the exact time of occupancy, especially during peak periods.

During check-in, the following requirements apply:

  • The same credit/debit card used for booking is mandatory.
  • Your government ID is required.
  • Your passport must be presented.
  • All members in your group must appear at the front desk for check-in and must sign the HOA ZERO TOLERANCE agreement to receive their wristbands.

SECTION 13. Check-Out Procedures: Check-out occurs at the reception desk where you initially checked in. Kindly return the keys to the front desk during check-out; a $45 USD fee is applicable for lost keys to rekey the lock. Guests who fail to vacate the rental property and return the keys by 11:00 AM without the consent of the Rental Company are subject to a fee of $50 USD per hour.

As part of the check-out process, please adhere to the following:

  • Dispose of trash in the designated containers.
  • Turn off the air conditioner/furnace, fans, lights, coffeepot, etc.
  • Remove all perishables from the refrigerator.
  • Close and lock all windows and doors.

SECTION 14. Wristbands: Only individuals wearing the proper wristbands and staying at Sonoran Spa Resort are permitted to access common areas, including the swimming pool, tennis court, fitness center, and BBQ grills. If a wristband is broken, please return it to the front desk. Replacement will not be permitted if a broken wristband is not returned. Although wristbands are not easily breakable, the cost for replacing a lost wristband is $50 USD per night.

SECTION 15. Pets: No pets, including service animals, are allowed. Renters discovered with a pet in the property will face immediate eviction without a refund of any payments made. If you need to bring a pet, please inform us in advance so that we can provide you with information on boarding facilities in Rocky Point.

SECTION 16. HOA Resort Rules & Regulations: The administration of the association of the condominiums is the supreme authority on this property. All of their decisions are final. The condo you have rented is privately owned and the owner is sharing it with you. Please take care of it as though it were your own (or better). All Rules and Regulations of the Resorts are strictly enforced by HOA Management and Security and all have a ZERO TOLERANCE Policy. Violators will be held accountable; including, but not limited to, arrest by proper authorities, eviction from the premises and/or forfeiture of all money paid. Common areas cannot be used after 10:00 PM – ATVs, RVs, Jet Skis, Sand Rails, and trailers must be parked in the designated areas only, (along the Wall in front the North building or the second row of parking in the same area) – Gas Grills are not allowed in the Resort – Is prohibited to us propane tank gas in the resort – The BBQ area (next to the tennis course) is charcoal only – Hanging clothes or towels on the rails of patio is prohibited – Throwing objects from the balcony of the condo is prohibited – Intense games on the balcony is prohibited – Nudity, impudent acts and indecency are prohibited – No speeding inside the resort – You must rinse off sand before going into the pools – Driving vehicles in the beach areas is prohibited – No nudity in the swimming pool areas – No running in the swimming pool areas – Children under 12 must be supervised by an adult at all times in swimming pool area – Pool hour are from 9:00 AM  to 10:00 PM – Please ask security to turn on Jacuzzi – Using pool bridges as trampoline is not allowed – No food inside or around the swimming pool area – Bonfires and fireworks at the beach are NOT ALLOWED. ATV’s are NOT ALLOWED on the beach. Camping is NOT ALLOWED on the property. No glass containers/glasses are allowed at the pool or on the beach – For your safety, wait at least 1 hours after a heavy meal before entering the pool. If you are evicted by the HOA for not following their Rules and Regulations you will not receive any refund and all monies paid are forfeited.

SECTION 17. Linens and Towels: Each property is equipped with provided linens and towels. However, bed linen and bath towels are not changed during your stay. We offer an initial set of bath soap, toilet paper, laundry soap, and trash bags. Additional supplies can be obtained at the front desk. Excessive consumption may incur additional charges.

Please refrain from using our towels to remove makeup, henna tattoos, or other products or chemicals that could cause damage or stains. Additionally, do not wash them with your colored items. By using our Linen and Towels, YOU AUTHORIZE us to charge your credit/debit card for any loss or damages resulting from misuse.

SECTION 18. Smoking Areas: All Rocky Point Resorts are smoke-free in compliance with Mexican law, which strictly prohibits smoking anywhere within the resort premises or inside the condominiums. Discovery of smoking inside the condo will result in the forfeiture of your deposit. Designated smoking areas are available; please inquire at the front desk for their locations.

SECTION 19. Furnishings: Furnishings may be changed without prior notice. It is prohibited to remove or transfer furniture, bedding, utensils, plates, cups, or any other property supplied with the rental property from one unit to another. The guest(s) will be charged for the loss of these items or damage to the property or furnishings beyond normal wear. In case of a lack of hot water, please check the hot water heater switch in the laundry area.

SECTION 20. Parties and Reunions: Parties and guests are NOT ALLOWED in the properties. NO loud noises after 10:00 PM Allowed.

SECTION 21. Loss or Damages: Please promptly report any visible damage upon check-in. All properties undergo inspection at check-out, and any deposit made is subject to forfeiture for lost or damaged items. As the registered occupant of the property, you are the responsible party for any damages incurred to the property or its contents by you or any other member of your group. All properties are inventoried, and deductions will be made for any missing or damaged kitchen utensils and appliances, linens, towels, decoration items, furnishings, equipment, and any other property damage.

Upon departure, it is your responsibility to secure the property. Turn off all lights, A/C-heat, and close all windows and doors. The captured amount is an estimate and may vary from the actual cost of repairs. A statement detailing damages and repair costs will be provided after completion. Any refund due will be returned to your credit card once all repairs are finalized. If funds cannot be collected from your credit card, you agree to allow us to seek restitution through legal means.

If no loss or damage is discovered, the hold on your security deposit will be released within 5–7 days after the property inspection. Before departing, turn off the air conditioner/furnace, fans, lights, coffeepot, water heater, etc. Remove all perishables from the refrigerator, close windows and doors, and ensure they are locked. By placing a security deposit on your reservation, YOU AUTHORIZE us to make charges against it.

SECTION 22. Property: While we strive to keep you in the room initially assigned during the reservation creation, we reserve the right to relocate you to an equally accommodating unit if necessary, due to maintenance, security, or other circumstances beyond our control. We apologize in advance for any inconvenience this may cause.

SECTION 23. Lost and Found: The rental company and property owner will not assume responsibility for personal property left behind or lost by guests during their stay. If any personal items are found, we will make efforts to notify you. Upon request, we are willing to ship these items to the registered guest. Shipping charges will be applied to the guest once a valid credit card number is provided. Unclaimed items will be held for a maximum of 30 days after check-out.

SECTION 24. Violation of Agreement: The Rental Company may terminate this Agreement and enter the premises if Guest(s) violates any of the conditions outlined herein. Upon receiving notice of termination, Guest(s) must immediately vacate the premises and forfeit all rents and security deposits.

SECTION 25. Indemnification and Hold Harmless: Guest(s) agree to indemnify and hold harmless the Owner and the Rental Company from any liabilities, theft, damage, costs, or expenses arising from or related to any claim or litigation connected to Guest(s)' use and occupancy of the rental property. This includes, but is not limited to, claims of liability for personal injury, or damage or theft of property, whether made, incurred, or sustained by Guest(s).

SECTION 26. Jurisdiction: Renter agrees that the state of Arizona will be the Jurisdiction for this transaction.

NOTE: CPMR, LLC dba CASTAWAYS and any of its affiliates, or the resorts it represents cannot be responsible for lack of electricity due to power outages having anything to do with storms, the electrical company (CFE) or by any other means out of our control. Nor can we be held responsible for water shortages which occur due to the lack of water in the town of Puerto Peñasco. Guests unconditionally release CPMR, LLC dba CASTAWAYS its employees and/or its agents, and the homeowners from any and all claims resulting in personal injury, damage, theft, or loss or damage of any personal items including but not limited to vehicles, clothing, money, etc. We are not responsible for any forgot or lost items. If making this reservation online customer is responsible for accuracy of information made during booking and cannot hold CPMR, LLC dba CASTAWAYS and any of its affiliate’s responsible for errors.
